- SMS / Text Marketing. If you opt in to SMS communications, we may use your phone number (via Klaviyo or a similar platform) to send promotional text messages and order updates. Message and data rates may apply. You may opt out at any time by replying STOP to any text message.
- Advertising and Retargeting. We use data collected via the Meta Pixel, Google Ads tags, and similar tools to measure ad performance and to serve targeted advertisements to you on platforms such as Facebook, Instagram, and Google. This may include showing ads to users with similar characteristics to our customers (lookalike audiences).
- Analytics and Site Improvement. We use tools such as Google Analytics to understand how users interact with our Site, improve our Services, and optimize the customer experience.
- Security and Fraud Prevention. We use your information to detect, investigate, and take action against possible fraudulent, illegal, or malicious activity.

Most browsers accept cookies by default. You can choose to remove or reject cookies through your browser controls, but doing so may affect your user experience and certain features of the Site. SECTION 5 — HOW WE DISCLOSE YOUR INFORMATION
We may disclose your personal information to third parties in the following circumstances:
- With service providers who perform services on our behalf, including Shopify (e-commerce platform), Klaviyo (email and SMS marketing), Meta (advertising), Google (analytics and advertising), payment processors, and shipping and fulfillment partners.
- With business and marketing partners to provide services and advertise to you. Our partners use your information in accordance with their own privacy notices.
- When you direct or consent to our disclosure of certain information to third parties, such as to ship your products or through your use of social media integrations.
- In connection with a business transaction such as a merger, acquisition, or sale of assets.
- To comply with applicable legal obligations, respond to subpoenas, search warrants, or similar legal requests.
- To enforce our Terms of Service or to protect the rights and safety of Summit Hound, our customers, or others.
We do not sell your personal information to third parties for their own independent marketing purposes. We do not use or disclose sensitive personal information beyond what is necessary to provide our Services.
SECTION 6 — DATA RETENTION
How long we retain your personal information depends on the nature of the data and the purposes for which it was collected. As a general guideline:
- Customer order and account information is retained for a minimum of 5 years to comply with tax, legal, and business record-keeping obligations.
- Email and SMS marketing data is retained for as long as you remain subscribed. Upon unsubscribing, your contact information is suppressed but may be retained in records to honor your opt-out preferences.
- Usage data and analytics data is typically retained for 26 months, consistent with Google Analytics default settings, unless otherwise configured.
- Customer support communications are retained for 3 years from the date of the interaction.
We will delete or anonymize your personal information when it is no longer needed for the purposes described above, unless we are required to retain it by law.

Depending on where you live, you may have some or all of the following rights regarding your personal information. These rights are not absolute and may be subject to certain exceptions under applicable law.

- Right to Withdraw Consent. Where we rely on your consent to process your information, you may withdraw that consent at any time.
- Right to Opt Out of Marketing. You may opt out of receiving promotional emails at any time by clicking the unsubscribe link in any email. You may opt out of SMS messages by replying STOP to any text message. Opting out of marketing does not affect transactional communications related to your orders.
- Right to Appeal. If we decline to process your request, you may appeal our decision by contacting us directly.
To exercise any of these rights, please contact us using the details in Section 11. We will not discriminate against you for exercising any of these rights. We may need to verify your identity before processing your request.
SECTION 8 — FLORIDA RESIDENTS
If you are a resident of Florida, please note the following in connection with the Florida Digital Bill of Rights (FDBR) and other applicable Florida privacy laws:
- We collect the categories of personal information described in Section 2 of this Privacy Policy.
- We use that information for the purposes described in Section 3.
- We do not sell your personal information to third parties for monetary consideration.

- We will respond to verified consumer requests within 45 days, with a possible 45-day extension when reasonably necessary.
As Summit Hound grows, we will continue to monitor and update our practices to remain compliant with applicable Florida and federal privacy laws.
SECTION 9 — CALIFORNIA RESIDENTS
If you are a California resident, the following additional disclosures apply under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):
In the past 12 months, we have collected and disclosed the following categories of personal information for business purposes:
- Identifiers (name, email, address, IP address, device identifiers)
- Personal information categories listed in the California Customer Records statute (name, address, payment information)
- Commercial information (purchase history, shopping behavior)
- Internet or network activity (browsing behavior, interaction with our Site and ads)
- Geolocation data (approximate location based on IP address)
California residents have the right to know, delete, correct, and opt out of the sale or sharing of their personal information. We do not sell personal information for monetary consideration. However, our use of the Meta Pixel and Google Ads tags may constitute "sharing" of personal information for cross-context behavioral advertising under California law. SECTION 10 — INTERNATIONAL USERS
We are based in the United States and our Services are primarily directed at U.S. customers. If you access our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where our servers are located and our central database is operated.
If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, the following applies:
- We process your personal information on the legal bases of contract performance (to fulfill your order), legitimate interests (marketing and fraud prevention), and consent where applicable.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we sell or share personal information of individuals under 16 years of age.

SECTION 2 — PHYSICAL PRODUCT USE & ANIMAL SAFETY
Summit Hound products — including collars, harnesses, and leashes — are physical goods designed for use with dogs. By purchasing and using any Summit Hound product, you expressly acknowledge and agree to the following:
- You assume sole responsibility for properly fitting all products according to the sizing and fitting instructions provided. It is your responsibility to verify that the product fits correctly and securely before each use.
- You assume sole responsibility for supervising your animal during all use of Summit Hound products.
- You assume sole responsibility for the behavior, actions, and control of your animal at all times, regardless of whether the animal is wearing or using a Summit Hound product.
- No collar, harness, leash, or similar restraint device can guarantee the containment or control of any animal under all circumstances. Dogs may behave unpredictably, and you accept the inherent risks associated with owning and handling animals.
- I Spy Productions LLC shall not be held liable for any injury, damage, loss, or harm to any person, animal, or property arising from the use, misuse, or improper fitting of its products, including but not limited to incidents resulting from improper fit, failure to supervise, animal behavior, or use of the product in a manner inconsistent with its intended purpose.
IMPORTANT — "Bully Proof" Brand Clarification: The term "Bully Proof" as used in Summit Hound product names and marketing refers exclusively to the durability, construction quality, and suitability of the product for use with bully breeds and large, powerful dogs. It does not constitute, and shall not be interpreted as, a guarantee, representation, or warranty that the product will prevent a dog from escaping, breaking free, causing injury, or otherwise being uncontrollable. The customer assumes full responsibility for proper use and fit.
SECTION 3 — ASSUMPTION OF RISK
You acknowledge that owning, handling, and restraining powerful dog breeds involves inherent risks, including the risk of injury to yourself, other persons, or other animals. By purchasing and using Summit Hound products, you voluntarily assume all such risks. You further acknowledge that Summit Hound products are tools to assist responsible pet ownership and are not a substitute for proper training, supervision, or responsible handling of your animal.
Summit Hound products are intended for use by adults who are capable of safely handling large or powerful breed dogs. Use of Summit Hound products by minors or individuals who are unable to safely handle such animals is done entirely at the customer's own risk.
SECTION 4 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless I Spy Productions LLC and its officers, directors, employees, affiliates, agents, contractors, licensors, service providers, and suppliers from any claim, demand, loss, damage, cost, or expense — including reasonable attorneys' fees — arising out of or related to:
- Your breach of these Terms of Service;
- Your violation of any law or the rights of any third party;
- Your failure to properly fit, use, or supervise the use of any Summit Hound product;
- The behavior or actions of your animal while using or not using Summit Hound products;
- Any incident, injury, or damage caused by your animal, whether or not a Summit Hound product was in use at the time.
SECTION 5 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. We do not warrant that results obtained from use of the Service will be accurate or reliable.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products delivered to you through the Service are provided "as is" and "as available" without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall I Spy Productions LLC, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind — including lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages — whether based in contract, tort (including negligence), strict liability, or otherwise, arising from:
- Your use of any Summit Hound product or service;
- Any products procured using the Service;
- Any errors or omissions in any content;
- Any injury, damage, or harm resulting from the behavior of your animal while using or not using Summit Hound products;
- Any loss or damage incurred as a result of the use of the Service or any content posted, transmitted, or otherwise made available via the Service.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
SECTION 6 — DISPUTE RESOLUTION & ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms of Service, or the breach, termination, enforcement, interpretation, or validity thereof, or the use of Summit Hound products or services — including any claim for personal injury or property damage — shall be resolved exclusively through binding individual arbitration, rather than in court.
The arbitration shall be conducted by a single neutral arbitrator in Palm Beach County, Florida, under the rules of the American Arbitration Association (AAA) or JAMS, as agreed upon by the parties. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
CLASS ACTION WAIVER: You agree that any arbitration or legal proceeding shall be conducted on an individual basis only. You waive any right to bring or participate in any class action, collective action, or representative proceeding against Summit Hound.
SMALL CLAIMS EXCEPTION: Notwithstanding the above, either party may bring an individual action in small claims court for disputes that qualify under applicable small claims court rules.
SECTION 7 — GOVERNING LAW & JURISDICTION
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action not subject to the arbitration clause above shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you hereby consent to the personal jurisdiction of such courts.
SECTION 8 — PRODUCTS & SERVICES
Certain products or services may be available exclusively online through the website and may have limited quantities, subject to our Refund Policy available at thesummithound.com/pages/return-policy.
We have made every effort to display product colors and images as accurately as possible. We cannot guarantee that your device's display will be accurate. We reserve the right to limit sales of our products to any person, geographic region, or jurisdiction, and to discontinue any product at any time without notice.
For warranty coverage on physical products, please review our One Year Warranty Policy at thesummithound.com/pages/1-year-warranty-terms. The warranty covers manufacturing defects under normal use and does not cover damage resulting from misuse, improper fit, modification, or normal wear and tear.
SECTION 9 — ACCURACY OF BILLING & ACCOUNT INFORMATION
We reserve the right to refuse any order at any time. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address provided at the time the order was made.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store, and to promptly update your account information — including your email address and payment details — so we can complete your transactions and contact you as needed.
